Kelly Rutherford's Newfound Fears

Two-year marriage of Gossip Girl mom Kelly Rutherford and entrepreneur David Giersch has indeed gone sour.
Just recently, four months pregnant actress Kelly Rutherford files emergency papers to bar her estranged husband David Giersch from leaving the USA with their 2-year-old son Hermes.Do you think it is a desperate move from the gorgeous actress so that Hermes will never ever be out of her sight?


According to Rutherford, "I feel there is some risk that he will leave the country with Hermes and I will not know where they are." Is that a sign of helplessness from the actress that Hermes will be gone for good?

Furthermore, Gossip Girl actress says that during their marriage, estranged David Giersch informed her of a pending investigation in his hometown Germany that might be a reason of his arrest. Rutherford also states that Giersch has a bad temper, stating that he "has a history during our marriage of getting angry with me and leaving, without telling me where he is going."

Meanwhile in L.A. Superior Court, estranged husband David Giersch counteracted the divorce case filed by Gossip Girl actress in December 2008, declaring legal separation and sole legal and physical custody with visitation from estranged wife. Giersch claims that Rutherford is ill tempered. He further states that Kelly Rutherford has once thrown a laptop at him and has punched him with her fist.

Likewise, Rutherford requested the court permission of travel to New York with son to continue her commitments with Gossip Girl.

This was strongly opposed by Giersch as he claims to be the main caretaker of Hermes in L.A. He could barely stand allowing his son live in a hotel with a New York lifestyle. He further claims that Kelly Rutherford's commitments with Gossip Girl along with her constant travel to New York is the main reason why their marriage ended.

In his words, "(Rutherford's) routine is that she has weekly hair appointments for at least two hours, manicures, pedicures, shopping and the like. She has been able to do all of that because I have been taking care of Hermes, and am happy to continue doing so, as it would be best for him."

A judge however refused Rutherford's request of traveling with Hermes. Instead, the judge has set a court date of Jan. 21 to further discuss the matter.
